The 457 Visa - Employer Sponsored Workers

EMPLOYER SPONSORED WORKERS
THE ‘457 VISA’
EMPLOYER’S GUIDE

The ‘457 Visa’:

. This is the most commonly used program for Australian Employers to sponsor overseas workers to work in Australia on a temporary basis

Key Features:

  • Employer Sponsorship is valid for 2 years
  • Employer Nomination is valid for 12 months
  • The Visa is valid for 3 months to 4 years
  • Priority is given to ‘Occupations in Demand’ such as cooks, bakers, carpenters, bricklayers, panel beaters, mechanics and welders

What Does the Employer Have To Do?

Step 1: The Employer Applies to be a Sponsor

The Employer provides (as applicable):

Business Registration Certificate
ASIC Registration Certificate
ABN/ARBN
Business publicity material (if any)
Details of how Sponsoring the overseas Employee will either:

  • create or maintain employment
  • expand the trade of the Employer
  • develop links with international markets or
  • improve the competitiveness of the Employer in Australia

Details on the Employer’s training activities, plans and strategies
(Possibly) a statement prepared by a CA/CPA or Bank outlining the ability of the Employer to meets its financial obligations as a Sponsor

Step 2: The Employer Nominates a Position to be Filled

The Employer provides details on (as applicable):

  • The position to be filled (which must be full-time)
  • The gross salary to be paid (minimum of $41,850.00 or $37,665.00 for ‘Regional’ Employers)
  • The duties/responsibilities of the position
  • The qualifications, skills and experience required for the position
  • The proposed period of employment and weekly working hours
  • The Employee to fill the position (if known)

**Note: Steps 1 and 2 may be combined in the one Application

**Note: ‘Regional’ Employers may be able to apply for reduced minimum skills/salary levels when located in a regional area (eg. ACT)

Step 3: The Employee Applies for a Visa

All Step 3 requirements (including skills and health checks) are dealt with by the Employee/Agent in the overseas country

How Long Will It Take?

Approximately 4-6 weeks from the time of lodgement of the Visa Application to the grant of the Visa

How Much Will It Cost?

  • Nomination Charge - $55.00
  • Sponsorship Charge - $270.00

What Services Will Burns&Burns Migration Provide?:

  • Assist you to prepare the Employer Nomination
  • Lodge online all required documentation on your behalf
  • Deal with any enquiries from IMMI
  • Liaise with the overseas Employee/Agent to ensure Employee compliance and eligibility
  • Assist with the preparation of any related documentation (such as employment contracts)
  • Liaise with the overseas Employee/Agent concerning Employee arrival in Australia
